For parents getting a divorce, a mutually comfortable custody agreement is one the most important steps to secure a safe environment for children going forward. A child custody agreement letter will spell out the terms of custody that both parents agree to. This is more than just which parent gets full-time custody; it also covers the visitation rights of the non-custodial parent.

Format and Content
As with any child support letter, a child custody agreement letter format most conform to any state guidelines. It is a good idea to have any letter with such a sensitive topic reviewed by a lawyer. The content needs to include which parent will have full-time custody and detail all visitation options for the remaining parent. Important dates such as birthday and holidays should be included in the document and agreed to by both parents. Both will sign the document and often it will be submitted to a state or circuit court.

Both parents have already agreed to the terms within the letter and, once signed, it will be approved by a state official or court. In this agreement, the mother has full-time custody of the two children, and it provides explanations for holidays and other important dates. In this letter I have included all the terms we discussed with our lawyers regarding child custody. Please review it and return it if you think it looks fair. Once it is signed, the letter will be submitted to the state court.
Father: Maurice Jones
Mother: Sara Jones
Children: June Jones, age 6, and Lester Jones, age 8
Both parents agree that day-to-day custody will go to the mother and she will have full-time responsibility regarding both children. The mother has agreed that the father shall have regular access and visitation with the children and will not restrict communication.
Weekends: The children will spend every other weekend with their father.
Birthdays: Both parents will share reasonable access on children’s birthdays. Each parent will have the opportunity to have the children visit on their (the specific parent’s) birthday.
Holidays: Parents will alternate Christmas and Spring Breaks. Thanksgiving and Easter will also be alternated. Summer vacations will be split evenly between the two parents.
Mother’s and Father’s Day: Will be spent with the respective parent.
Other visitation: The mother agrees that the father’s visitation will be allowed within reason and scheduled so that both parents are happy.
Any disagreements in these terms will be moderated by mediation and not by the courts. Terms of this agreement are subject to change as the children age and make decisions about their own free time. Both parents agree to be respectful of these wishes and let them take precedence within reason.
The details in this agreement have been approved by both parents and are submitted to the court for final approval.
